Approximately 3AM defendant traveled off the road way into an open field after losing control of the vehicle and the vehicle overturned. Defendant was transported to local hospital where he was met and questioned by troopers. Defendant admitted to operating vehicle and consuming alcohol. Trooper administered field sobriety test at the hospital and subsequently defendant submitted to breath test testing .185g%.
At trial the state presented the arresting officers testimony and supporting documentation. Counsel argued that the state failed to prove that the defendant was intoxicated at time of operation, since the accident occurred 5 hours prior to the test.
Counsel further argued that vehicle had actually overturned approximately 60 yards in an open field which constituted operation of a motor vehicle on private property. The trial judge agreed with counsel suppressing the breath test and found the defendant not guilty of driving under the influence.
